Each volunteer must sign the “Release and Waiver of Liability” before working activities or events related to Mountain Cats TNR. Read this waiver very carefully before you sign. This Waiver of Liability (the “Waiver”) executed on the day indicated below by the volunteer indicated below in favor of Mountain Cats TNR, Inc., a nonprofit corporation organized and existing under the laws of the State of West Virginia USA, and their directors and officers. I, the Volunteer, desire to work as a volunteer for Mountain Cats TNR and engage in the activities related to being a volunteer and to working with cats. I hereby freely and voluntarily, without duress, execute this Waiver under the following terms: 1. WAIVER AND RELEASE - I the Volunteer, release and forever discharge and hold harmless Mountain Cats TNR, Inc. and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from my volunteer work with Mountain Cats TNR, Inc. I understand and acknowledge that this Waiver discharges Mountain Cats TNR, Inc. from any liability or claim that I, the Volunteer, may have against Mountain Cats TNR, Inc. with respect to bodily injury, personal injury, illness, death, or property damage that may result from my volunteering at Mountain Cats TNR, Inc. related activities, be it trapping feral cats, caring for cats at the cat shed or at adoption events, during transport of cats, fostering or other activities. I also understand that Mountain Cats TNR, Inc. does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health or disability insurance, in the event of injury, illness, death or property damage. Insurance - I the Volunteer, understand that I expressly waive any such claim for compensation or liability on the part of Mountain Cats TNR, Inc. beyond what may be offered freely by the representative of Mountain Cats TNR, Inc. in the event of such injury or medical expense. Indicate your agreement with the above waiver and release conditions by adding your signature below: * 3. MEDICAL TREATMENT - I hereby release and forever discharge Mountain Cats TNR, Inc. from any claim whatsoever which arises or may hereafter arise on account of any first aid treatment or other medical services rendered in connection with an emergency during my time with Mountain Cats TNR, Inc. Indicate your agreement with the above waiver and release conditions by adding your signature below: * 4. ASSUMPTION OF THE RISK - I understand that my time with Mountain Cats TNR, Inc. may include activities that may be hazardous to me, including, but not limited to, handling cats whose health may not be known, transporting cats to and from medical appointments and off site events. I hereby expressly and specifically assume the risk of injury or harm in these activities and release Mountain Cats TNR, Inc. from all liability for injury, illness, death, or property damage resulting from the activities of my time with Mountain Cats TNR, Inc. OTHER - I expressly agree that this Waiver is intended to be as broad and inclusive as permitted by the laws of the State of West Virginia in the United States of America, and that this Waiver shall be governed by and interpreted in accordance with the laws of the State of West Virginia. I agree that in the event that any clause or provision of this Waiver shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable. CONFIDENTIALITY CLAUSE - I the Volunteer, agree that at all times and notwithstanding any termination or expiration of this Agreement I will hold in strict confidence and not disclose Confidential Information to any third party, except as approved in advance and in writing by Mountain Cats TNR, Inc. and will use the Confidential Information for no purpose other than as directed and authorized by Mountain Cats TNR, Inc. Notwithstanding the above, said Volunteer shall not be in violation of this Paragraph with regard to a disclosure that was in response to a valid order by a court or other governmental body, provided that said Volunteer provides Mountain Cats TNR, Inc. with prior written notice of such disclosure in order to permit the organization to seek confidential treatment of such information. Indicate your agreement with this clause by adding your signature below. * For purposes of this Agreement, “Confidential Information” shall mean all information or materials provided to the Volunteer by Mountain Cats TNR, Inc., verbally or in writing. Confidential information includes all information about people (e.g., donors, members,fosterers, adopters), Mountain Cats TNR, Inc.’s financial details, proprietary information, and other organizations. Examples of confidential information are given below: Donor names, contact information, and donation amounts Prospective adopter or fosterer names, contact information, and personal information gathered during the application process Mountain Cats TNR member names, contact information, and personal information gathered during the application process Bank account information, balances, logins Internal business processes
